After Shein promised to pay ICMS for purchases below US$50, the Institute for Retail Development (IDV) protested once morest the measure and said that the company cannot pay ICMS to the consumer.

The president of IDV, Jorge Gonçalves Filho, told “O Globo”:

Shein cannot be a substitute for collecting tax from the consumer who made the purchase. The consumer is responsible.

He also said that the majority of states have not yet adapted to the reality of Conformal Remittance. Therefore, the integration of the tax system with the Post Office has not yet been carried out.

The IDV president also said that the limitations prevent Shein from carrying out this operation and paying the tax now.

On the other hand, tax lawyer Bianca Xavier says that Shein can indeed make the payment to the consumer. For her, the Chinese retailer’s action should simply simplify the collection process, meaning that the customer does not have to deal with other processes outside of the purchase.

Ana Paula Tozzi, from AGR Consultores, said that Shein’s measure may even be regular, but it “goes over” what was agreed by Remessa Compliance, ensuring that the consumer buys at the price charged before the program came into effect.

For now, Shein has not commented on the matter, while the IRS has not commented either.
