Requirements for undocumented immigrants to drive in Florida

Florida, one of the most popular tourist destinations in the United States, is also home to a large immigrant community.

Among the basic services that many choose to acquire is renting or purchasing a vehicle to get around.

In this context, knowing the requirements for driving in the state is essential to avoid penalties and ensure a safe experience.

Beyond the driver’s license

While a valid driver’s license is an essential requirement for driving in Florida, it is not the only one.

The Florida Department of Highway Safety and Motor Vehicles (FLHSMV) requires drivers to have two essential insurance policies:

  • Personal Injury Protection (PIP) Insurance: Covers up to 80% of the driver’s medical expenses in the event of an accident, regardless of fault. The minimum coverage required is US$10,000.
  • Property Damage Liability (PDL) Insurance: Liability for damages caused to third party property in the event of an accident. The minimum coverage required is also US$10,000.

Requirements

  • Continuous coverage: Insurance must remain active even if the vehicle is not being used.
  • Authorized insurance company: The policy must be issued by an insurance company licensed to operate in Florida.
  • Maintaining coverage: Florida insurance coverage must be maintained throughout the vehicle’s registration, even if the vehicle is out of state. Exceptions apply only to military members stationed overseas.

Penalties for non-compliance

Failure to comply with Florida auto insurance requirements can result in severe penalties, including:

  • Suspension of driving license for 3 years.
  • Payment of a reinstatement fee of up to $500.
  • Recommendations:
  • Take out insurance that meets all legal requirements.
  • Check with your insurance company to see if your policy specifically covers Florida.
  • Keep proof of current insurance inside the vehicle.
