Request for re-examination of the mental status of the accused who beat the lover to death

Regarding the case of a woman being assaulted in a hotel in Ca Mau, the representative of the victim has submitted a request to re-assess the mental status of the accused.

The representative of the victim in the murder case that occurred at the TN hotel in Ca Mau on November 10, 2022 has just sent an application to the authorities of Ca Mau province to request a re-assessment of the mental status of defendant Nguyen. Van Xuan (57 years old, living in Ward 8, Ca Mau City).

Mr. Xuan was the one who assaulted Mrs. NTT (40 years old, living in Nam Can district, Ca Mau province) in the hotel, causing the victim’s death afterwards.

The representative of the victim said that the family did not agree with the conclusion of the psychiatric forensic examination dated January 17, 2023 of the Southwest Forensic Psychiatric Center for Mr. Xuan’s mental condition.

“Before committing the crime, Mr. Xuan had absolutely no history of mental illness; the conclusion of the assessment was only determined at a too short time to ensure objectivity; Mr. capable of perceiving and controlling behavior before, during and after the crime”, the victim’s representative stated in the application.

Therefore, the representative of the victim made a request to the authorities of Ca Mau province to decide to request the Central Forensic Psychiatry Institute to re-examine Nguyen Van Xuan in accordance with the law.

Ca Mau provincial authorities said that they have received the request of the representative of the victim and continue to consider it.

Like People reported that Mr. Nguyen Van Xuan and Ms. NTT had a romantic relationship between men and women.

Around 6pm on 9/11, Mr. Xuan and Mrs. T. came to rent a room at a hotel in Ward 5, Ca Mau City. At 8 am on November 10, Mr. Xuan used a wooden chair to beat Ms. T. to collapse on the spot.

Then, a son of Mr. Xuan came to take him out of the hotel, but was detained by the police force. Ms. T. was taken to the hospital by her relatives with a diagnosis of multiple injuries and died on the afternoon of the same day.

Recent assessment results show that, before committing the crime (on November 9, 2022), Mr. Nguyen Van Xuan was not mentally ill. From November 9 to November 10, Mr. Xuan suffered from multiple acute psychotic disorders without symptoms of schizophrenia.

After committing the crime (November 10) and presently, Mr. Xuan has a psychotic disorder, acute polymorphic psychosis, and has no symptoms of schizophrenia.

At the time of the crime (November 10) and now, Mr. Xuan lost the ability to perceive and control his behavior, the acute stage of the disease.

Currently, Mr. Xuan is not healthy enough to conduct investigation, prosecution and trial activities. He belongs to the case of compulsory medical treatment under Decree 64/2011/ND-CP.
