In the twelve-member body, only the representatives of the SPÖ and the Greens voted in favor and thus remained in the minority. The application to the state parliament is therefore also to be rejected. It was found that there was a connection between the alleged criminal offense and the political activities of the second president of the Lower Austrian state parliament, Gottfried Waldhäusl. The state parliament therefore wanted to decide that an official persecution of the FPÖ politician would “not be approved”. The next session of the state parliament will take place on Thursday next week (May 25).

In connection with the transfer of unaccompanied minor refugees to the asylum accommodation in Drasenhofen (Mistelbach district) surrounded by barbed wire in November 2018, Waldhäusl and a former state official were accused of abuse of office. In 2022, a month-long process followed at the regional court in St. Pölten, which ended with final acquittals.
