Rentals: what are the changes to the law approved by the Senate

The Senate approved a reform to the current Rental Law, which establishes changes in the form of contracting and adjustments of values.

This proposal was promoted by the ruling party and, due to the differences with the project that had come from the Chamber of Deputies, it will have to return to it to achieve its final approval.

The central points of the approved project establish:

► The contracts will continue to maintain the valid for 3 years.

Adjustments will be made semi-annually. instead of annual as they currently are.

► For adjustments, the “Own House” index which takes into account the lowest index between the average salary variation of the last year and the average inflation of the same period. Currently it is carried out through the ICL prepared by the Central Bank where it also combines wage increases and inflation but in different percentages.

► Contracts must be made in National currency.

► There will be tax incentives for those who put their home for rent.

From the real estate sector they are skeptical in terms of a positive effect in a market with a strong contraction in supply.

Differences with the project approved in Deputies

The project approved in the Upper House differs from the project approved by Deputies. In this one, returned to the two-year term for rentals, with updates every four months and freedom to choose the index between the parties.
