Austria will not bring an action for annulment against the EU renaturation law. This was confirmed by a spokesman for Constitutional Minister Karoline Edtstadler (ÖVP) in the afternoon. The necessary agreement with the ministries concerned “could not be achieved”. The deadline for filing the lawsuit has now expired.
The ÖVP announced the nullity appeal after Climate Protection Minister Leonore Gewessler (Greens) voted in June to approve the renaturation law against the will of her coalition partner and helped the motion achieve a narrow majority.
But this is now off the table: The answer to Gewessler’s breach of the law “should not be another one”. As Constitutional Minister, it is “not an option” for Edtstadler to ignore the requirements of the law and state practice.
