Philippe has lived in Clunisois since 1996. He is a former professor of visual arts and art history.

For several weeks, Philippe’s life has changed. Indeed, his nightmare began when EDF came to his house to cut off the electricity.

Philippe had been asking for a new electricity meter for several months, but… especially not the Linky meter! Indeed, since its deployment in 2015, the little green box does not make everyone agree!

In March 2023, three Enedis agents rang at Philippe’s door.

“They came back with a Linky meter. I said I didn’t want to. But apparently they didn’t know. After that, I sent letters asking for my meter to be changed and it lasted for months. In May, I got a phone call from an Enedis representative who asked me why I didn’t want the Linky meter. I replied that I had my reasons. », then confided Philippe in the columns of France Info Bourgogne Franche Comte.

He receives threats

Philippe assured our colleagues that one of the representatives then threatened him.

“I was told: if you don’t want the Linky meter, you will have a power cut. I answered “but it is illegal”. “Yes, but it’s that or nothing” I was told. », Philip continued.

On May 27, a team of three agents rang his doorbell once more.

“Sir, we’re cutting off your power because you don’t want a Linky meter. They told me they would check to see if there was an index on my old meter. And they took the opportunity to block and cut the current. », he said.

Since then, Philippe has been living an unnamed nightmare!

“I live without electricity, I walk around with a headlamp at night or in dark rooms. Last night I fell because I mightn’t see anything on the stairs. I eat cold, I go to friends to recharge my cell phone. And my batteries for my headlamp. All my cold food is at my friends. »

Unable to use life support to provide oxygen

While he has health concerns, Philippe lives without electricity. It was therefore impossible for him to use his artificial respirator to provide him with oxygen.

“My doctor and my pulmonologist prescribed me a long-term condition, a serious phase of my illness. I have severe breathing difficulties, and that since April 14, 2004. then added the one who refuses the Linky meter.

Philippe then decided not to let it go.

“I called the police to file a complaint. They checked and phoned EDF. A gendarme contacted an EDF adviser who told him “we are not aware that the electricity has been cut off. »… not to mention his denial of a Linky counter.

His refusal to counter Linky made him lose 6 kg in 15 days

“For me, it is an offense by abuse of weakness. I need to get the power back. I am in a state of law, this cut is illegal. EDF can cut off electricity to bad payers, or by court order. But I did nothing. », he then added.

This former art history professor can’t take it anymore! “I’m at my wit’s end, my doctor whom I’ve known for more than 20 years told me ‘Philippe, I’ve never known you like that.’ I lost 6 kg in 15 days, I can’t sleep anymore. I am in constant difficulty breathing. », he then confided.

“I don’t know how long I will last. Friends told me “Philippe, let it go”. But I don’t feel like, it’s not me who’s at fault. I am deprived of an energy which is a citizen’s right. », he then concluded.

Supported by the association alert citizen urban community 71 (ACCU 71) of which he is a member, Philippe filed a complaint for abuse of weakness.

Enedis’ response:

While France Info Burgundy Franche Comte contacted Enedis, he claims that the replacement of his defective meter with a Linky meter had received authorization from the Mâcon court.

Here is Enedis’ response to our colleagues:

– « Manager of the public electricity distribution network, Enedis makes safety its first priority. If the defective state of an electricity meter is proven, Enedis replaces it in order to preserve the safety of people and property.

” In the present case, the Mâcon Judicial Court, in its decision of June 8, 2023, confirmed Enedis’ right to replace the customer’s defective meter with a Linky meter. Pursuant to the contractual provisions binding it to Enedis. And in compliance with the legal framework for deploying Linky meters”.

« Enedis recalls that the electricity meters belong to the AODEs (Energy Distribution Organizing Authorities), which entrust Enedis with the operation of the public electricity distribution network through concession contracts”

– « Today, and in compliance with the law (article L341.1-4 and R341.8 and following of the energy code), 1 million Linky meters are installed in Burgundy (Côte d’Or, Nièvre, Saône & Loire, Yonne). That is 92.6% of equipped households which are now billed on actual consumption and no longer estimated”.

– « Customers also benefit from other advantages. Such as more precise monitoring of their electricity consumption, new tariff offers offered by electricity suppliers. As well as faster and remote services such as reading consumption or changing power”.
