A decree published in the Official Journal on Friday puts an end to the use of the term “like new” for the sale of refurbished products, reports Money Vox. Sellers of revised products such as tablets, smartphones or computers will therefore have to review their selling points.
Backmarket, one of the leaders in the refurbished market, which makes it possible to obtain second-hand electronic devices checked and cleaned by professionals at reduced prices, used to use this term when it offered items whose condition aesthetic and functional was impeccable. The platform has taken note of the new law and affixes to objects, previously referred to as “like new”, a label “perfect condition”.
“New” or “as new” also prohibited
Similarly, the legislator indicates that the words “new” or “as new” are also prohibited. A second-hand product therefore remains a second-hand product. The date of application of the measure is amended to 1 January. This text also sets out the conditions that must be validated in order to use the terms “reconditioned” or “reconditioned product”.
Thus, the device sold must have “undergone tests on all its functionalities in order to establish that it meets the legal security obligations and the use that the consumer can legitimately expect”, can we read. In some cases, the device must have “undergone one or more interventions in order to restore its functionality”. There is at least one intervention to be made: “the deletion of all data recorded or stored in connection with a previous use or a previous user, before the product or part changes ownership”.
Another clarification, for the reseller who would like to highlight his activity on the exclusive territory, the mention “reconditioned in France” can only concern products whose various operations for its proper functioning have been “carried out entirely on the national territory”. .
