Reckless Driver: Multiple Offenses, Traffic Violations, and the Consequences – Story of José

José, 42, has been sentenced seventeen times by the police court, fifteen of which by default, for traffic violations. Exasperated, the judge imposed a work sentence of 160 hours on June 21, 2021, and confiscated his driving license.

On October 14, 2022, José must go to the place where he must carry out his work sentence. It’s autumn, it’s not very good. José decides to take his brother-in-law’s car, even though the latter formally forbids him to drive his car. He knows the coconut and he knows that he no longer has the permit. This is only theft of use within the meaning of the law. The worse is yet to come.

Multiple Offenses

Here is our good José on the Borean roads, driving the stolen car. José is driving at high speed, which attracts the attention of a police patrol who chases him through the streets of Boussu. The police turn on the blue lights of their car and the siren howls at all costs. José does not stop, despite police orders.

“He overtakes on a white line, he takes a prohibited direction in the opposite direction, he drives on sidewalks and cycle paths, he takes a towpath and ends up being blocked by the police. His escort leaves the vehicle, he no longer has a voice so much he cried out in fear”, says the deputy prosecutor.

But that doesn’t stop José, who presses the button to get on the highway. “He is driving at 190 km / h, overtakes on the right and takes the emergency lane”, continues the deputy prosecutor who requires a two-year sentence, while not opposing a simple reprieve, “hoping he will understand”.

And the bike?

José, good chic good kind, explains that he had no other way to get around. “Where were you meeting? ”, asks the judge. José replies that it was in Boussu, where he lives. “And you needed a car? The bike was enough. You did not need to put the lives of others in danger”, shouts the judge.

José replies that the police officers extrapolated in their report, that he never put anyone’s life in danger and that he even never had an accident. However, he admits having made a mistake and swears that he will never be summoned by justice again.

His lawyer, Me Fabrice Guttaduaria believes in this father of three children, who has worked all his life. “He does not have the profile of a delinquent, except in terms of driving. He has already paid thousands of euros in fines. There is a form of duality in him which is quite challenging,” says the lawyer who pleads for a work sentence. Behind the wheel, José is no longer the same man.

José the driver will be fixed on his fate at the start of the school year.
