As reported, in the investigation into serious fraud in connection with the taking advantage of elderly landowners suffering from dementia, the Wels public prosecutor’s office has transferred its responsibility to the economic and corruption public prosecutor’s office (WKStA).
The amount of damage in the case of a deceased large farmer from Pasching, who left 39 hectares of land not to her legal heir, but to another relative, is likely to be more than five million euros. This establishes the responsibility of the WKStA.
Martin Ortner, spokesman for the economic and corruption public prosecutor’s office, informed OÖN at the request of the OÖN that the psychiatrist who is said to have written a courtesy report on the question of legal capacity was released from custody on Thursday. But that doesn’t mean that the expert will no longer be investigated. On the contrary: “Nothing has changed in the suspicion of the crime. However, there are more lenient measures against maintaining pre-trial detention,” said the authority spokesman. The imposition of pre-trial detention was initially based on the assumption that there would be a risk of repetition and obscurity. A more lenient measure could be a vow to remain available to law enforcement authorities at all times.
Condition of the elderly lady exploited?
