Real estate advertisements must inform the tenant of the “maximum rate”

This obligation will take effect on April 1 in several municipalities.

Real estate professionals will now have to display a maximum rental price, an obligation provided for by the rent control.

“For properties located in areas subject to rent control, this text provides that professionals must now provide essential financial information in real estate advertisements to inform consumers in their choice of rental”, indicates the ministry.

This information is the reference rent, fixed by decree according to the characteristics of the property (district, date of construction, furnished or unfurnished); this rent increased by 20%, ie the limit authorized by the rent control; and, if necessary, the additional rent, which makes it possible to exceed the limit if the property has certain characteristics of location or comfort.

Soon to be extended to individuals

The obligation “will also soon be extended to advertisements published by individuals”, underlines the Minister of Housing, Emmanuelle Wargon.

Agents, representatives, etc., who must now display the rate of their fees, will now have to specify that it is a “maximum” rate, in order to give clients the possibility of negotiating it at the decrease.

The rent control applies in Paris, Lille, Lyon, Villeurbanne and in 18 municipalities of Seine-Saint-Denis. Bordeaux and Montpellier are to be added in 2022.
