The Supreme Court of Pakistan has fixed the Punjab Election Tribunals case for hearing on September 24.
According to the details, the appeal of the Election Commission in the Supreme Court on the issue of formation of election tribunals in Punjab has been fixed for hearing.
A five-member bench headed by Chief Justice Qazi Faiz Isa will hear on September 24. Justice Aminuddin, Justice Jamal Khan Mandukhel and Justice Aqeel Abbasi are included in the bench while Justice Naeem Akhtar Afghan will also be a part of the five-member larger bench.
It should be remembered that the court had stopped the tribunals from working on the last hearing while the court had also directed the Chief Election Commissioner to consult the Chief Justice of the Lahore High Court.
The Supreme Court had adjourned the hearing of the case related to Election Tribunals in Punjab till consultation of Election Commission and Chief Justice of Lahore High Court.
Background of the case
It should be remembered that on June 14, the Supreme Court had scheduled the application for hearing against the decision of the Election Commission of the Lahore High Court to form the Election Tribunal.
On June 14, the Election Commission of Pakistan had challenged the Lahore High Court’s decision to form election tribunals in the Supreme Court.
The Election Commission filed an appeal against the decision of Justice Shahid Karim of Lahore High Court.
In the petition, the position has been adopted that the formation of election tribunals is the authority of the Election Commission, the decision of the Lahore High Court to form tribunals is against the law and the High Court cannot use the powers of the Election Commission.
The Election Commission has requested the Supreme Court to annul the decision of the Lahore High Court and schedule the appeal for hearing tomorrow.
It should be noted that the Lahore High Court had decided to form 8 election tribunals. Based on the decision of the Lahore High Court, Acting Chief Justice Shahzad Malik had issued orders to form 8 tribunals.
The Election Commission challenged the decision of the Lahore High Court in the Supreme Court and took the stand that the decision of the Lahore High Court is against the law.
The Election Commission requested the Supreme Court to suspend the decision of the Lahore High Court. After the decision of the Supreme Court on the appeal of the Election Commission, all the election tribunals formed in Punjab were suspended on the order of the Lahore High Court on June 12.
