Public-private partnership: local authorities will soon apply it

To boost the development of local authorities, the government of Me Apollinaire Kyelem de Tambèla will table, on the desk of the Transitional Legislative Assembly, a draft decree on the terms of implementation of the public-private partnership (PPP) by the local authorities (CT) in Burkina Faso. But before this step, the Executive, which wants a flawless legal text and especially taking into account the opinions and the adhesion of all the stakeholders, brought together the actors for a validation of the project of the said decree “PPP” local authorities. Which meeting took place on Tuesday, June 27, 2023, in Ouagadougou.

The Minister Delegate for the Budget, Fatoumata Bako/Traoré, justified the government’s option for PPPs because of the insufficiency of internal resources, PPPs appeared necessary to contribute to the reduction of the significant deficit of infrastructures necessary for the provision of public services for the benefit of the population. Also, she said, Burkina Faso has chosen to use the expertise and know-how of the private sector, for the realization of structuring investments, through the PPP.

This choice is part of the diversification of sources of government financing to strongly involve the private sector in the implementation of its investment program both at the central and decentralized levels. In the opinion of the Minister, the regions and the Communes are showing a growing interest in the use of this tool as a means of creating local development infrastructures, on the one hand, and in their limited capacities to conduct the PPP process of somewhere else ; the need to complete the regulatory system for effective and efficient management is essential not only to facilitate their use, but also to better protect them once morest the risks associated with this modality.

The said draft decree was made possible thanks to Swiss Cooperation, through financial support which will make it possible to strengthen the operational capacities of local authorities in the conduct of the PPP process.

Its concrete implementation?

Once the draft decree has been adopted, how can local authorities set up the system?

To this concern, the coordinator of the PPP Unit, Sié Philippe Aimé Palenfo, suggested that the investments to be made should relate to the areas of competence transferred. Better still, he says, these investments which will be made within the framework of the PPP will have to take into account the financial capacity of each local authority. Another clarification is that ARCOP will have its say on the award of contracts, in order to ensure that they comply with the texts in force.

The draft text was drawn up by the Public-Private Partnership Unit, in collaboration with representatives of the Ministry of Territorial Administration, Decentralization and Security, the Public Procurement Regulatory Authority and all the structures involved in the public procurement chain, as well as other key players identified in the decentralization process. The text includes 11 chapters and 44 articles, it sets the conditions under which local authorities can resort to PPP and the principles of governance of the process.o
