PTI Challenges Practice and Procedure Amendment Ordinance – Pakistan

Pakistan Tehreek-e-Insaf (PTI) challenged the Practice and Procedure Amendment Ordinance in the Supreme Court, while the petition sought to declare the Practice and Procedure Amendment Ordinance null and void.

A third petition against the Practice and Procedure Amendment Ordinance was also filed in the Supreme Court. The petition was filed on behalf of Chairman PTI Barrister Gohar, in which the Federation, the Ministry of Law and the Secretary to the President were made parties.

The petition requested that the Practice and Procedure Presidential Ordinance be declared unconstitutional while the new Judges Committee should be restrained from forming benches till the final decision, and the old Practice and Procedure Judges Committee should be restored.

It was argued in the petition that the Practice and Procedure Amendment Ordinance is against the fundamental rights and the Constitution, the amendment ordinance is tantamount to taking away the independence of the judiciary.
