COMMISSION III DPR RI confirmed that it would investigate the complaint regarding alleged legal intimidation once morest PT Tri Bakti Sarimas (TBS), which operates in Kuansing Regency, Riau. This step is a follow-up to PT TBS’s complaint to Parliament.

Heru said that a summons to the relevant parties, namely Bank Rakyat Indonesia (BRI), was needed to shed light on the issue of the polemic. Moreover, in this case, the Riau Regional Police have named two high-ranking PT TBS officials as suspects.

“I think we need to deepen this and then we cannot take information from one side. So we need to deepen it further. Later we will summon, we will use our supervisory rights and we will summon parties from the Bank and the Regional Police, namely the Director of Criminal Investigation,” said Member of Commission III, Heru Widodo, at the Parliament Complex, Jakarta, Thursday, (7/3).

This PKB politician believes that there are many irregularities in the legal process carried out by the Riau Regional Police once morest high-ranking PT TBS officials. Moreover, the legal process related to the Bank Rakyat Indonesia (BRI) auction process for assets belonging to PT TBS is still ongoing at the Riau High Court.

“This should be resolved first and then there will be a legal process at the Regional Police. But this turns out to be a kind of overstepping of other laws, and I think we will look into this further later,” he said.

In the complaint received by Commission III of the DPR, said Heru, PT TBS and BRI had actually agreed to pay the shortfall in transactional credit payments specifically for Working Capital Credit (KMK) in stages. However, due to financial problems due to Covid-19, PT TBS has not been able to carry out the agreement.

On the other hand, PT TBS and BRI also agreed to postpone the payment of KMK deficiencies. This issue has even been brought to the Riau High Court to be resolved.

“But then it turned out that in the process of filing the high court, there was a legal process from the Regional Police that was continuing so that the land owner was the suspect,” he said.

Previously, PT TBS complained to Commission III DPR RI to obtain protection regarding asset disputes with BRI. This complaint was made because PT TBS felt they had received legal intimidation from parties who had a polemic with the company.

PT TBS’ attorney, Andry Christian, assessed that there were irregularities and legal flaws in the determination of the two PT TBS leaders as suspects. In particular, in the BRI auction process for PT TBS assets which was allegedly carried out by related individuals.

He said that on December 28 2023, BRI, through the State Property and Auction Services Office, auctioned land belonging to PT TBS which consisted of 14 plots of land which were intended, among other things, for oil palm plantations covering an area of ​​17,612.5723 Ha located in Kuantan Singingi Regency, Riau. PT TBS has been running its business and participating in developing the local area since 1986.

The land was previously used as collateral for a credit facility at PT BRI Tbk. in the form of credit facilities ‘Special Transactional Credit Agreement for Working Capital Credit (KMK), Forex Line and Debt Recognition, since 2018.

Due to the impact of Covid-19 in 2022, PT TBS then had difficulty making installment payments to BRI. At that time, to pay for the credit facilities provided by BRI, PT TBS had requested that payment obligations be restructured to complete the credit payments.
