Prosecution waives appeal: acquittal for father final

Following the acquittal in a murder trial at the Innsbruck Regional Court of a 39-year-old who was accused of throwing his mentally handicapped son into the Kitzbüheler Ache in St. Johann in Tirol in the summer of 2022 and thereby killing him, the public prosecutor’s office has waived his right to appeal.

This was confirmed by prosecutor spokesman Hansjörg Mayr on Friday. The verdict, which was unanimously passed by the jury, was therefore legally binding.

“The verdict is clear”

The jury’s verdict was “clear,” said Mayr. There was also no indication of any errors in the trial and therefore no reason to challenge the verdict before the Supreme Court (OGH). There is therefore “nothing to shake” the jury’s acquittal. The 39-year-old German’s defense attorneys have already been informed.
