On February 13, the source of PLO said the People’s Procuracy of Binh Thuan province has completed the indictment, transferred to the provincial People’s Court to prosecute Tran Huu Lan (39 years old, living in Lien Huong town, Tuy Phong district, Binh Thuan) for murder.
According to the indictment, around the beginning of July 2022, Lan bought a revolver, white, black plastic butt, and nine bullets from an unidentified man on Highway 1A, Lien town Huong for 15 million dong brought home and kept.

Around 6:00 p.m. on July 24, 2022, Lan came home from work and saw Huynh Phan Nhan (33 years old) and his biological father Nhan standing at their land next to Lan’s house.
Lan thinks that the land is their own, but Nhan’s father and son uprooted the concrete fence Lan had planted earlier, so he took a roller gun, inside there were six bullets stuffed into the pocket of the jacket he was wearing and went out to where Nhan and his son were standing. .
After the quarrel, Lan pulled out a gun and shot two times in the air and then shot two consecutive shots, hitting Mr. Nhan’s head and chest. Lan also took the piece of bamboo from Nhan’s hand and hit him on the head, causing the victim to collapse on the spot.
Lien Huong town police made a record of red-handed crime for Lan’s behavior, seizing a rulo gun with symbol 21TH017501, four used cartridges, two unused bullets and inside the handle cover with the other three bullets were unused.
Mr. Nhan was injured and was taken to the emergency room and treated for his injuries. Concluding the assessment, Mr. Nhan has a body injury rate of 11%. The wounds were all caused by fire.
The gun is a military weapon, belonging to a hand-made revolver that shoots explosive (5.6 x 15)mm bullets. The five unfired bullets and four fired cartridges are all sports ammunition, size (5.6 x 15)mm, not military weapons.
During the assessment, the Criminal Science Institute of the Ministry of Public Security in Ho Chi Minh City used 2/5 of the bullets for experimental shooting and concluded that the above revolver was used with bullets of size (5.6 x 15). mm in the body can cause injury or death.
For this act, on December 20, 2022, the People’s Court of Tuy Phong district sentenced Lan to one year in prison for illegally possessing and using military weapons.
Up to now, Lan’s family has compensated 100 million VND for the cost of treatment for injuries and mental loss to the victim. Lan has already compensated for the damage and honestly declared that he should be entitled to the extenuating circumstances of his criminal liability.
According to the indictment, Lan used a military weapon with high lethality, which when shot at another person has the potential to cause death. Therefore, considering the nature and extent of Lan’s crime, it is particularly serious, showing the aggressive thugs specified at Point n, Clause 1, Article 123 of the Penal Code and committing the crime in an unsatisfactory case.
