The White House has prepared amendments to a bill simplifying the return of ownerless property to circulation. In particular, it is proposed in a simplified manner, on the basis of an inspection report (without carrying out cadastral work), to carry out state registration (including deregistration) of rights to real estate objects that “ceased to exist as a result of hostilities”. The amendments developed by Rosreestr were approved on June 19 by the government commission for legislative activity (Vedomosti got acquainted with the document and accompanying documents). Government amendments are proposed for the second reading of the bill, which was submitted to the State Duma in September 2022 by a group of deputies and senators from United Russia (it passed the first reading in December 2022).
Parliamentarians initially proposed to simplify and unify the procedure for identifying and accepting ownerless and escheat property into municipal ownership. “There are situations when a real estate object – an apartment, a residential building, a land plot – exists, but the owner of it is not established in the USRN. There are almost 25 million such facilities in our country,” said the deputy, co-author of the bill, Daniil Bessarabov. “Various violations are possible here, including fraudulent actions in relation to this property.” According to him, “it is often impossible to find the owner, or the former owners abandoned the property”: “We have provided for the obligation of the municipality to file a statement that this property is ownerless and register it in the real estate register in a simplified manner. In a year, the municipality will be able to give this property to those in need or to specialists.”
