From the hypothesis of a reform of pretrial detention to prison overcrowding. The approval of the measure wanted by Minister Nordio on the last day of work before the summer break of Parliament, far from dispelling concerns and controversies about the living conditions of prisoners, has opened new fronts for the executive, some of which could create new frictions in the majority. In the meantime, President Mattarella has promulgated the same Prisons decree and the signature on the Nordio bill for the cancellation of abuse of office is expected shortly, which, according to what has filtered out, should not be accompanied by any message of reminder to the government and Parliament. The central issue remains the question of living conditions in prison, on which the Minister of Justice says he is ready for new “short and medium term” solutions, and the opposition attacks: “The government is going on vacation but overcrowding remains”, says the secretary of +Europa Riccardo Magi, while Roberto Giachetti, together with Nessuno tocchi Caino, files a complaint against the minister because “not preventing an event – the document states – that one has a legal obligation to prevent, is equivalent to causing it”.

Precisely on the issue of prison overcrowding, Nordio announced his intention to meet Mattarella, but the appointment will not be set before September, so that the Ministry can illustrate to the Quirinal the initiatives it intends to undertake. In the meantime, the moods of the majority on the issue are different: from Forza Italia and Noi moderateti, in favor of seeking solutions against what Maurizio Lupi bluntly brands as a “shame”, to Fratelli d’Italia who through the voice of Augusta Montaruli specifies: “We are for a balance between the execution of the sentence and the principle of social reintegration of the prisoner”, “never pardon or amnesty with the Meloni government”.

On the cancellation of abuse of office, the constitution gives the head of state one month to sign (the Nordio bill was approved on July 10) and – as Lapresse has learned – the promulgation will arrive within the constitutionally foreseen timeframe. The Minister of Defense Guido Crosetto also intervened on the point, to clarify that “I would never attack Mattarella”, after having relaunched the tweet of the Azione deputy Enrico Costa who yesterday highlighted the failure to promulgate the law 28 days after its approval. It was precisely from the Azione deputy that the motion for a reform of pre-trial detention in prison came. This is “the theme of themes” according to the Forza Italia deputy Pietro Pittalis, who adds: “The Toti case is an emblem of this” and “our proposal aims to ensure that the assumption on which the hypothetical reiteration of the crime is based is specifically motivated”. The leader of Iv Matteo Renzi also opens up, who is against the penal shield for governors suggested by Deputy Prime Minister Salvini, but to those who propose that for minimal crimes there should be no precautionary custody, he responds firmly: “Very well, let’s talk about it”. And if the issue is dear to criminal lawyers, with the president of the Union of Criminal Chambers Francesco Petrelli who speaks of a “reform that can no longer be postponed”, on this point Fratelli d’Italia is holding back, which – from parliamentary sources – underlines that there is still no text to discuss.
