Deputies presented a project that establishes the right not to receive unintentional calls, so they can only call you if you previously authorize it. In addition, you have the right to ask how they obtained your data; and if they call you against your will, they can be fined up to 91 million pesos.

A group of deputies, led by Gonzalo Winter (CS), They presented a bill to eliminate spam calls from commercial houses.

As detailed in the initiative, companies will be able to continue issuing calls with offers and services, only if the person receiving the call indicates that they are in favor.

Also, if the calls persist, the responsible company could receive a fine of up to 91 million pesos.

While, if the users request it, they will be able to know where they obtained their telephone number for commercial purposes.

In the document, the parliamentarians allude to the fact that when the Christmas and New Year celebrations approach, companies tend to increase their calls offering products and services.

Even the deputies point out that these calls become tedious and insistent, to the point of being considered “spam” for those who receive them.

Given the daily occurrence and persistence of this problem, legislators presented a bill that regulates this -“sometimes tedious”- mechanism used by call centers to obtain clients.

The project presented by the Social Convergence deputy, Gonzalo Winter, has the support of deputies Maite Orsini (RD), Marcela Riquelme (ind-CS), Lorena Fries (CS), Javiera Morales (CS), Mercedes Bulnes (ind -CS), Alejandro Bernales (PL) and Boris Barrera (PC).

“People should be free to choose the goods and services they wish to purchase. Likewise, the user must be able to decide if he wishes to consume . This principle is violated when a company, through a call center, interrupts the life of a person by calling without prior authorization, to a personal telephone”, asserted the deputy who heads the project, Gonzalo Winter.

To this he added that “it is necessary to protect the privacy of people and their right to choose whether or not to be the object of publicity, to an object as private as the telephone. For this reason, this project points to the heart of the relationships between consumers and companies, seeking to level the playing field and balance the asymmetric relationship that exists between individuals and businesses”.

“For years, companies have used people’s private phones to call them at the time they determine. Therefore, appropriate the time of the people, to be able to make their sales”, indicated Winter.

He also explained that “they have developed a new technology that consists of being able to call hundreds of people at a time through machines, and leave them waiting in line, to see if their executives manage to intercept the call.”

The initiative also responds to the classic question that users ask themselves when receiving these calls: “And where did you get my number from?”this then, if requested, may be delivered by the referred company.

“This project seeks that companies that want to communicate by telephone with potential clients to make proposals, can only do so with the express authorization of the same and – transparently – if required by the user, the way in which their data was obtained, thus limiting – in pursuit of people’s cybersecurity – the sale of data”, said deputy Orsini, belonging to the Security Commission.

Although there is a “Do Not Disturb” platform of the National Consumer Servicethis measure seeks that users can decline to receive offers and services by telephone, quickly and without online procedures.

The project has already been presented at the Chamber of Deputies and Deputies and it is expected that it will be reviewed in the Economy Commission.
