Producers in RJ will be able to have their soybean harvest preserved

With the prospect of remaining high in 2024 due to the prolonged drought, as rains are expected to remain irregular in the State, soybean producers are seeking, in court, to protect the harvest, which is already affected. Research released by Aprosoja in December 2023 indicates that production should be reduced by 20% due to changes in the climate.

This loss of a considerable part of the harvest has already raised concerns among producers and some have even filed for judicial recovery. In several of these requests, lawyers are requesting that production not be seized or subject to enforcement actions during the ‘stay period’, a period of 180 days of shielding of legal or physical companies undergoing judicial recovery.

Specialist in judicial recovery, lawyer Antônio Frange Junior highlights that soybean bags are essential for producers, as are trucks for transport companies and machinery for contractors, among others. “Soy is essential for the producer and this protection is necessary so that he can renegotiate his debts with banks, investment funds and other suppliers and, in this way, recover financially and maintain his activities”, explained the lawyer.

Recently, the Goiás Court of Justice adopted this understanding and protected the production of a rural businessman undergoing judicial recovery. “The case of the rural producer is atypical compared to other common companies and, in most cases, the agricultural product is the main currency of exchange capable of boosting the business, so that acts of constriction and expropriation of assets can put at risk the continuity of business activities and the very purpose of the institution of judicial recovery”, says an excerpt from the understanding of the 7th Civil Chamber of the Court of Justice of Goiás.

Antônio Frange understands that any and all protections for rural producers guaranteed by law must be considered by the Judiciary. He mentions, for example, that the sector was responsible for maintaining the Brazilian trade balance during the pandemic period and is one of those that employs the most in the country.

Even so, it is not immune to crises, mainly due to the heat waves of 2023. “Judicial recovery is a means of keeping the sector thriving, generating employment and income for the State and municipalities that have agricultural production as their main source. of tax collection”, he pointed out.

CRISIS AFFECTS THE STATE

In an event held this Monday, governor Mauro Mendes (União) also mentioned that public authorities will be affected by the ‘crop failure’ in the countryside. According to him, the decrease in production due to the weather will mean that goods do not circulate in the appropriate volume, generating losses in the collection of ICMS (Tax on the Circulation of Goods and Services), in addition to Fethab (Transport and Housing Fund).

“It will not be a year like 2023, 2022 and 2021. It will be a year of some level of difficulty, our revenue will be impacted, Fethab will be impacted. Directly or indirectly, our revenue depends on our economic activity. This will have some consequences in the daily lives of all of us, citizens, mayors, secretaries”, warned the governor.
