According to the lawsuit, the companies would have conspired to reduce the number of Apple resellers, resulting in benefits for them. Prior to an agreement reached in 2018, Apple products were only available in marketplaces from third parties — where prices were sometimes lower, but quality was not always guaranteed.
From the following year, the number of resellers suffered a considerable drop, supposedly in a planned way. Apple’s new policy limited the sale of its products only to authorized resellers or those who purchased large quantities of refurbished products every 90 days, harming small merchants.
This change represented a significant difference from the previous policy. The lawsuit alleges that the number of Apple resellers on Amazon declined by 98% — from nearly 600 to just 7.
The process, opened by the law firm Hagen’s Berman, says Amazon benefited by selling the devices at prices 20% higher than they otherwise would have been. For the plaintiffs, the agreement is illegal and violates US antitrust laws by harming competition between independent dealers.
With this new decision, the class action can proceed, allowing the plaintiffs to present their arguments once morest both Apple and Amazon. Until the last update of this matter, neither party had publicly commented on the matter.
