The president of the judges’ association, Sabine Matejka, has criticized the turquoise-green federal government in connection with the lack of appointments to the management of the Federal Administrative Court (BVwG). Matejka was quoted as saying in the “Kurier” (Friday edition) that the coalition justified the continued vacancy with “political voting” as “a contradiction in terms”: “There should be no ‘political voting’ when filling an independent court.”

Here she would like “more sensitivity to the matter and the separation of powers,” emphasized Matejka, who is considered the favorite for the job. According to reports, she is said to have emerged as the best-ranked applicant from the selection process.

The appointments committee, which included VfGH President Christoph Grabenwarter and ex-Justice Minister Clemens Jabloner, had submitted the proposal to the coalition months ago. However, the appointment stands in the way of filling another top job, namely that of the also vacant chief post in the Federal Competition Authority. There, the People’s Party wants the current Vice President of the Federal Administrative Court, Michael Sachs, as head, but this has so far failed due to resistance from the Greens.
