Practice and Procedure Act: Endeavor to complete hearing today: Chief Justice

The hearing on 9 petitions filed related to the Supreme Court Practice and Procedure Act has started which is being covered live by the state TV. The Chief Justice said that they are trying to complete the hearing today, it is not right if the Supreme Court will sit with only one case.

After assuming office, Chief Justice Qazi Faiz Isa scheduled the Supreme Court Practice and Procedure Act for hearing before the full court and for the first time in the history of the Supreme Court, the hearing was telecasted live.

Today’s hearing
In the Supreme Court, the Chief Justice of Pakistan, headed by Qazi Faiz Isa, is hearing the full court petitions, in which the Chief Justice said at the beginning of the hearing that they are trying to complete the hearing today, it is not right if the Supreme Court will sit with only one case.

During the hearing, the Chief Justice said that today the effect of this law will be especially on the Chief Justice and two senior judges. Some judges believe that the authority of the Parliament and the Chief Justice is face to face, some do not think so.

Justice Qazi Faiz Isa said that all of you have written down your answers, we have the Attorney General and senior lawyers in front of us, everyone will listen.

Submission of responses to the court by the parties

Before hearing the petitions related to the Supreme Court Practice and Procedure Act, the parties have submitted written responses to the Supreme Court. Tehreek-e-Insaf has requested to declare the act null and void in its written responses.

The Attorney General, in his reply based on the questions of the judges, said that the suspension of the law by the 8-member bench was unconstitutional, the independence of the judiciary has been ensured by the Practice and Procedure Act, transparency in judicial matters and benches by the Act. A statute cannot be struck down on the basis of a presumption that the formulation would improve.

Muslim League (N) and (Q) have requested to dismiss the petitions against the Supreme Court Practice and Procedure Act.

Pakistan Tehreek-e-Insaaf has said in its response that the Practice and Procedure Act is against the independence of the judiciary, in the presence of the Supreme Court Rules 1980, the Parliament cannot legislate on the Supreme Court.

The lawyers of the petitioners, Khawaja Tariq Rahim and Imtiaz Siddiqui, have accepted the petitions and requested to declare the Supreme Court Practice and Procedure Act null and void.
