The legal representative of president-elect Prabowo Subianto and vice president-elect Gibran Rakabuming Raka, Otto Hasibuan, questioned the political stance of the PDIP in suing the KPU to the PTUN which was considered inconsistent.
The lawsuit was filed because PDIP considered that the KPU had committed unlawful acts which resulted in the presidential election results winning candidate pair number 2 Prabowo Subianto-Gibran Rakabuming Raka.
“On the one hand, Ganjar-Mahfud have congratulated Prabowo and Gibran. But on one side it was sued once more in the PTUN court. We don’t know which one is actually true. If you are safe, then the problem is over. Let’s build this nation well. How come it has a tail?” said Otto to media crew in the Senayan area, South Jakarta, Thursday (25/4).
“Frankly, if we think that the lawsuit from the PDIP team is actually from a political perspective, yes, this is inconsistent,” he added.
Otto reminded that the legal steps taken by PDIP were actually in vain. Because, according to him, if the lawsuit still concerns the KPU’s decision, then that is the domain of the Election Law.
“If it is an election law then it should be challenged through Bawaslu. If he doesn’t go through Bawaslu, he can go straight to PTUN. “Usually if there is a violation there will be a complaint to Bawaslu. If Bawaslu is dissatisfied you can appeal to PTTUN, if you are not satisfied you can go to the Supreme Court,” he explained.
“He didn’t sue Bawaslu through the PTUN. This is not what I see right. “I am sure and believe that the Constitutional Court’s decision is a final and binding decision, binding on all parties. I just have to wait for Prabowo-Gibran to be inaugurated as president in October and the lawsuit will just run its course, but we’ll see,” he added.
Even so, Otto stated that his party still respects the legal steps that have been taken by PDIP regarding the results of the presidential election which are still being litigated. (Z-8)
