Specializing in the installation of charging stations for electric cars, the company recently went bankrupt. Enough to embarrass many Belgians, like Raphaël, who had installed a terminal at his home. Questioned by RTL Info, the Branbançon no longer knows how to configure his terminal via his application. “The logins of the old accounts have been deactivated,” he laments. “The problem with that is that we can no longer configure the terminal. It is frozen in the current configuration.
The irony for the approximately 50,000 Belgian customers concerned is that you now have to pay to use the application once more. Indeed, taken over by the Luxembourg company Encevo at the time of bankruptcy, the application is now managed by the subsidiary MyDiego. The latter, wanting to make his purchase profitable, announced the bad news to customers by message.

“The subscription that I was asked for is around 120 euros per year,” explains Raphaël, who is also a terminal installer. “There were quite virulent reactions from customers. On the one hand, because they were worried regarding what would happen to their equipment following the bankruptcy, then they were quickly put in contact with the buyer. At that moment, they wondered why they had to pay when before it was free.”
For Alain Goldschmidt, a lawyer specializing in this type of business, clients have no other choice but to comply with the buyer’s conditions. “You should know that bankruptcy does not automatically end contracts that are in progress,” he explains. “It is necessary to examine the session agreement for the activity which was concluded between the curator and the acquiring company. Either the buyer commits and guarantees the execution and respect of current contracts, but this is quite rare, or he simply takes over an activity and makes no commitment or gives any particular guarantee. In a way, he does what he wants.”
