Police Inspector Bayunca: Provisional suspension of the Police Inspector of the district of Bayunca | Cartagena

The District Mayor’s Office of Cartagena through the Disciplinary Control Advisory Office ordered the provisional suspension of the Inspector of the district of Bayunca for a term of three months without the right to remuneration, within the disciplinary investigation that is carried out by alleged irregularities related to his exercise of office.

This decision was adopted on March 25, 2022following concluding within a disciplinary process that serious elements of judgment are evidenced that allow establishing, objectively, that if he continues in the position, function or public service, the inspector may carry out some type of interference in the investigation, or allow it to continue committing the offense for which he is being investigated or repeats it.

In the same way, another cause of law was taken into account to proceed with the decree of this precautionary measure of provisional suspension consisting of the fact that the conduct that is being investigated is immersed in the category of offenses classified as serious or very serious.

The suspended official in his capacity as Police Inspector of the Corregimiento of Bayunca, has in the Internal Disciplinary Control Advisory Office a considerable number of complaints filed by the community of the Corregimiento of Bayuncaregarding their conduct in the exercise of their functions, which are the subject of investigations, each for different facts and different complainants, this being the most serious complaint as it is a typical description in criminal matters, a circumstance that is another element taken into account to determine a probable non-observance of the rules of functional conduct as a public servant, ethics, duties, which leads to considering the decision to order the aforementioned preventive measure while the investigation is completed.

Currently, from the Disciplinary Control Advisory Office have been imposed on the official two statements of charges in two different processes that will be sent to the judging official in accordance with Law 2094 of 2021 and complementary regulations.

In the same decision, it was ordered to consult this decision before Mr. Mayor of Cartagena de Indias in relation to the Provisional Suspension, in accordance with the provisions of the regulations.

“It is important to highlight that the suspended public servant is innocent until he is found guilty with a punitive ruling, that he has the right to defense and to protect his image and his position by taking the actions that he deems necessary by law,” he said.
