“It clearly shows a certain failure of investigations in Rio de Janeiro, with regard to the second inquiry, which is investigating who ordered Marielle to be killed and what was the motivation for the crime”, points out Zaccone, who recognizes value in some advances in the investigation of the case.
“In the first investigation, the Civil Police were very successful in identifying, in a very competent way from a technical point of view, all the evidence that was constructed to impute responsibility for the execution of Marielle and Anderson to two people who are already arrested, with robust evidence, and they have been kept in prison for many years”, pointed out the delegate.
In March 2019, a year following the crime, the Civil Police of Rio detained retired police officer Ronnie Lessa, named as the shooter, and former military police officer Élcio Vieira de Queiroz, who would have been the driver of the car in pursuit of the former councilwoman. .
Both are imprisoned in federal penitentiaries outside Rio de Janeiro and are going to the popular jury, still no date determined by the Justice.

Orlando Zaccone: It clearly shows a certain failure of investigations in Rio de Janeiro, with regard to the second investigation, which is investigating who ordered Marielle’s death and what was the motivation for the crime. In other words, what happened in the investigations is that following discovering the author of the shots and other people who participated in the action, such as the driver (Élcio Queiroz) who was arrested along with the shooter, Ronnie Lessa, the motivation for the crime was not identified.
Every crime of homicide must have a motivation, according to the Penal Code. The doctrine only exempts from motivation if it is a case of unimputability, that is, when the person has no control over his actions, like someone with a mental problem.
When a person kills someone, he does it for a reason, which might be money, for example, but there is a reason. That’s what’s at stake now in the investigation of the Marielle case, finding out what was the reason that led to the decision to execute.
Is this second inquiry dragging on?
This second inquiry began to move when the [então] governor [do Rio de Janeiro] Wilson Witzel took over in 2019. At the time, an important witness emerged, the doorman of the [condomínio onde morava Jair Bolsonaro] Vivendas da Barra, who said that Lessa and his accomplice, Adriano -, who is not the (militiaman) Adriano da Nóbrega, whom they killed in Bahia -, arrived at the Vivendas da Barra condominium on the day of Marielle’s execution and wanted to speak with the “Seu Jair’s” house.
Bolsonaro was out of the country at the time and gave an embarrassed statement, being involved in Marielle’s death. However, this was all changed with a new statement from the driver, who contradicted what he had said before.
In the midst of all this, Governor Witzel was impeached and was called to testify at the Covid CPI in 2021 or 2022. Witzel said at the CPI that he was impeached in Rio de Janeiro because he had identified and arrested the author of Marielle’s execution.
However, the Rio police never called him to clarify this public statement, which is strange. In fact, anywhere in the world, when a politician makes a statement involving the crime of murder, it is widely accepted as a political crime and he should have been called to testify and explain the relationship between his impeachment and the arrest of the executioner of Marielle.
But this was not done. Therefore, much was not done in this investigation.
The conclusion is that there was failure?
But, answering your question, there is a failure in the investigation of the second investigation, because in the first one the civil police was very successful in identifying, in a very competent way from a technical point of view, all the evidence that was constructed to impute responsibility from the execution of Marielle and Anderson to two people who are already in prison, with solid evidence, and have been kept in prison for many years.
Now, what we need to clarify is the motivation and who ordered the killing, since everything suggests that Marielle’s execution was ordered. This is what we are dealing with in the second survey.
The entry of the Federal Police demonstrates a failure of the Civil Police, but the criticism cannot be limited to just one police agency. We also have the Public Ministry, which not only controls the actions of the police, but also acts directly in the investigation. If there is a fault, I believe there is, it is not just the civil police, but the criminal justice system of the state of Rio de Janeiro.
Five years following the crime, what can change in the investigation!? Those who had to flee, already fled. Who might hide money, already hid. Who might speak, has already settled down. Is it possible to move forward five years later?
The fact that five years have passed since Marielle’s execution does not prevent the investigation from reaching the principals, but for that it is necessary to clarify some things that were somewhat dubious in the first investigation. One is the visit of Marielle’s executors to Bolsonaro’s condominium, Vivendas da Barra.
Note that Lessa, who is the shooter, lived in the condominium, but the first information from the doorman was that Anderson, the driver, arrived and did not look for Lessa, he was looking for someone at “Seu Jair’s” house. This was later contradicted in a very strange way, as this doorman no longer appears and no longer works there.
And who has the book of notes he took on the day Adriano’s visit was recorded? The Public Ministry. There is a document showing that there was a communication between one of the prisoners in the execution, who was the driver Adriano, with someone who was at Jair’s house.
‘Seu Jair’ was not there, it is already proven that he was in Brasilia, but it is necessary to know who was at his house at that time. It is necessary to check many things.
Investigations have completely ruled out the possibility of personal motivation. It is necessary to unwind it.
The participation of former governor Wilson Witzel is fundamental, since at the Covid CPI he said that he was impeached due to the arrest of Marielle’s executors. He has to explain it, put it on paper and clarify it further, but so far, no one has called him.
What were the main errors in the investigation carried out by the MPRJ and the PC!?
So, we cannot speak of an error in the investigation, because we do not know it, it is under secrecy, that is, no one knows what information the Public Ministry of the state of Rio de Janeiro and the Civil Police obtained regarding the motivation for the crime.
This second inquiry is ongoing in secrecy. What we can say is that there has not been any news in relation to the case since it was initiated, that is, no names of people involved or in relation to the executors were presented.
The only information that emerged was that of the Vivendas da Barra condominium, which seems to have been forgotten and shelved, but there are documents that are in the possession of the Public Ministry and the Civil Police. The executors’ cell phones were seized and many things still can and should be verified.
We cannot say that there was an error in the investigation, since we do not have access to the procedure and what was done by the Public Ministry and the Civil Police in relation to the second investigation.
