Around 4 in the followingnoon on January 29, the National Electoral Council (CNE) received a formal request within the process carried out by that body for the possible violation of electoral limits of the Petro Presidente 2022-2026 Campaign.

In a short communication, former magistrate Julio César Ortiz Gutiérrez, representative of President Gustavo Petro, raised a request related to the inspection that the Prosecutor’s Office carried out at the headquarters of the Colombian Federation of Education Workers (Fecode), a week ago.

The letter, which EL TIEMPO learned regarding for the first time, is also signed by lawyer Germán Palacio Zúñiga, attorney for Ricardo Roa Barragán, manager of the presidential campaign and current head of the state-owned Ecopetrol, the most important company in the country.

Invoking the right to defense and contradiction, in the letter they ask the CNE to report whether this corporation participated in the inspection carried out by the Prosecutor’s Office, which President Petro described from the beginning as a raid.
In fact, this Friday he mentioned the issue once more, ensuring that the Prosecutor’s Office was going to criminally prosecute Roa Barragán.

“The desperate response will be not only to suspend the chancellor of the Republic, but also to criminally prosecute the president of Ecopetrol and the superintendent of Public Services for having been president of the Colombia Humana party. EL TIEMPO established that what the representative of the president seeks to determine is whether the CNE contributed in some way to the proceedings in Fecode without notifying the representatives, which would immediately annul it.
judicial inspection
This is the Fecode minutes where it states that the donation went to the Petro Presidente campaign.
In said judicial procedure, the sixth prosecutor’s office delegated to the Supreme Court, headed by prosecutor Gabriel Jaimes, went to look for a record and a deed.
Both are related to the donation – for 500 million pesos – that the educators union approved “to financially support the campaign of candidate Gustavo Petro for the Presidency of the Republic.”

Although the law prohibits legal entities from making contributions to campaigns, EL TIEMPO revealed the Fecode donation document, approved on May 3, 2022.
The disbursement – made on May 27, 2022, through check no. 4546139 – does not appear in the accounting that was presented to the CNE.
“With that contribution the limits might have been violated, conduct that has been penalized since 2017,” a person familiar with the case assured this newspaper.
This is the deed in which they clarify that, contrary to what was said in the minutes, the money went to Colombia Humana.

What has drawn attention is that, through a public deed signed on September 23, 2022 (four months following the disbursement of Fecode), the union indicated that the donation was going to the Colombia Humana party, “but not for the presidential campaign.” .

Quiroga, Superintendent of Public Services, has come out to explain that the Petro campaign rejected the donation because it was not allowed.

Furthermore, Colombia Humana used it for the implementation of the comprehensive electoral control scheme following the elections of May 29, 2022.

To clarify this point, they have already called several people who were involved in the disbursement and use of the 500 million pesos for questioning and testimony.

Other tests
On the CNE side, and as President Gustavo Petro’s lawyer has been informed, other tests have been ordered.
Among these, the National Registry was asked for a list of all the electoral witnesses of the Historical Pact coalition.

And, in parallel, several money transfer firms –Efecty, Matrix Giros, Supergiros, Su Red and JER– were asked to report the list of money transfers that they had received and/or issued to the electoral witnesses reported by the campaigns. first and second presidential round of the Historical Pact coalition.
The period being reviewed is from March 1 to October 31, 2022 and the delivery date, name and identification of the payer and beneficiary of each transaction are required. Due to the volume of information, several of the money transfer companies requested a deadline to send it, some of which will be met next week.
Response to agent
Although the CNE has not yet responded to President Petro’s representative, EL TIEMPO already knows the answer.
Sources from the Prosecutor’s Office reported that the diligence in Fecode was autonomous and individual and the CNE did not participate or request it.

In passing, they clarified that, contrary to what media other than EL TIEMPO have reported, it is also not true that the Supreme Court was present. In fact, sources from the high court confirmed this to EL TIEMPO.
However, this newspaper established that this high court is advancing another investigation related to the flight service subscribed to by both the Petro campaign and the Historic Pact for Congress 2022.

The common denominator is the Ibagué Air Society (Sadi SAS), movements that are not reported and a plane that would not have flight permission.
