Petition filed in Supreme Court to annul proposed constitutional amendment – Pakistan

A petition was filed in the Supreme Court of Pakistan to declare the proposed constitutional amendment null and void.

The petition was filed by Shafqat Mehmood, Shahab Sarki, Abid Zuberi, Ishtiaq Ahmed, Munir Kakar and others in the Supreme Court, in which the Federation, the four provinces, the National Assembly, the Senate and others have been made parties.

It was argued in the petition that the court cannot take back the power of the judiciary or tamper with the judicial powers.

The petitioners demanded that the proposed constitutional amendment be declared unconstitutional, that the proposed constitutional amendment be declared against the separation of powers and the independence of the judiciary.

The petition requested that the federal government be restrained from amending the constitution and also stop the process of tabling the proposed constitutional amendment bill.

Fazlur Rehman’s careful batting on both sides of the political pitch continues, no one and no yes on the constitutional amendment.

In the petition, it was also requested that if the parliament amends the constitution, the president should be prevented from signing it and the independence, powers and judicial affairs of the judiciary should be declared sacred.

It should be noted that a total of 54 proposals are included in the proposed constitutional amendment bill, however, there is no proposal to increase the tenure of the Chief Justice in the bill, but the procedure for appointing a new Chief Justice will be changed.
