When is the processing of personal data of a minor lawful?

Inside one pediatric study the healthcare professional comes into contact with a large amount of data:

  1. the parents’ personal data,
  2. the personal data of small patients,
  3. patients’ health data.

The pediatrician must be aware of the fact that according to art. 8 of the GDPR The processing of personal data of a minor is lawful where the minor is at least 16 years old. Where the minor is under the age of 16 years oldsuch processing shall be lawful only if and to the extent that such consent is given or authorised by the holder of parental responsibility. Member States may establish by law a lower age for such purposes provided that it is not less than 13 years.

For this reason, the law requires the healthcare professional to adequately inform the parents (but also the patients(when, based on their age, they are able to understand what is being said to them) how health data will be processed, where they will be stored, who will be able to access them and what their rights are.

The pediatrician must have the parents of his little patients sign a specific consent form for the processing of their health data.

Document Features

The document is free form and does not need to be written on the doctor’s letterhead. If the patient requests it, a copy of the signed form must be given to him: for this reason, it is always preferable to draw it up in two copies, one of which is given to the patient’s parents/guardian.

Content of the document

The document must contain all the data of the parents or guardian of the minor patient, as well as the data of the minor patient and those of the doctor, the references to the specific place where, within the office, the privacy information is located, the references to the information relating to the data and the contacts of the data controller and his representative, the purposes of the processing for which the personal data connected to the prevention, diagnosis, treatment and rehabilitation activities are intended, as well as the additional specific purposes, the subjects to whom these data may be communicated (pharmacy, specialist doctors, etc..), the period of retention of personal data, the indications relating to the patient’s rights regarding their personal data (limitation, rectification, cancellation, opposition, portability, revocation of consent, complaint to the Guarantor), the indication of the impossibility of providing the service in the event of failure to sign the consent.

Terms and conditions

The form must be signed by the parents of the little patient before providing the health service; a copy of the patient’s identity card must be attached to the signed form.

Once signed, the original form must be kept in a safe place within the medical office. It is advisable to have folders dedicated to consent forms, divided by year, month or by the initial of the patient’s surname.
