About 7,500 pensioners belonging to the special payrolls (retired, university students, etc.) have filed lawsuits claiming the return of the EAS for a 5-year period.
The detention of EAS was deemed unconstitutional by the Court of Auditors for the two years 2017-2018, to the old pensioners before May 2016.
The back payments due to non-claimants who are almost 350,000 State pensioners range according to the table compiled and published by the “Insurance and Pensions” insert from €575 for those with small deductions to €6,486 for pensioners with higher deductions EAS.
The individual decisions are from old lawsuits that were filed before the Court of Audit’s decision was issued and for this reason the old lawsuits have a 5-year retroactive period, while those who have not appealed are entitled to a 2-year retroactive period.
The EFKA has begun to pay those who have a decision that vindicates them, but the issue is that the EAS does not concern only those who have appealed but all State pensioners with main pensions or the sum of main pensions over 1,400 euros, as they are covered by the decision of the Plenary of the Court of Auditors.
The most likely of the scenarios that have been considered by the government’s financial staff is that the retroactive payments from the EAS will be returned to all State pensioners (except for those who have lawsuits with 5-year retroactive payments). The way they will be paid will be decided in total for the cases pending in the courts, that is, the retroactive package will also include the beneficiaries of 11 months’ refunds in the supplementary pensions. The decisions will be launched following the 17th of April, which is scheduled in the Special Court for the discussion on retroactive Gifts in pensions.

EAS is returned to pensioners before May 2016, according to the decision of the Court of Auditors
Approximately 6,000 pensioners of the municipalities who left with heavy status following May 2016 and received a pension without the increase provided for by law for the additional contribution they paid at a rate of 4.3% on the basic salary are entitled to retroactive pension increases of over 12,000 euros and the special employment allowance.
The increment they are entitled to is 0.075% per year for each unit of the additional 4.3% levy they paid for their specialty.
The correction of pensions should have already started, but is being delayed by EFKA. The recalculation of pensions with burden in the OTAs will be done for those who retired from 13/5/2016 onwards, which means that some will receive a pension increase retroactively for up to 8 years! (2016-2024).
For example:
*An OTA employee with 40 years of insurance, of which 15 in the heavy duty specialty with an additional monthly contribution of 4.3%, retired with a replacement rate of 50%, while with the increase due to heavy duty the replacement rate will become 54.84%. With a pensionable salary of 1,500 euros, he received a compensatory pension of 750 euros. With the new replacement rate (54.84%), the compensatory pension will reach 822 euros, which means a monthly increase of 72 euros. If he retired from the middle of 2016, then he will receive the 72 euros retroactively for 90 months with an amount of 6,480 euros.
*An OTA employee with 40 years of insurance, of which 25 in the heavy duty specialty with a contribution of 4.3%, will earn an additional 8.06% and the replacement rate will become 58.06%. With a pensionable salary of 1,500 euros, he received a compensatory pension of 750 euros and with the new replacement rate (58.06%) the compensatory pension will be recalculated to 870 euros, which means a monthly increase of 120 euros. If he retired in 2018, then he will receive the 120 euros retroactively for 72 months with an amount of 8,640 euros.
Does the special pension increase apply to the other heavy categories in the private sector?
In the heavy private sector, the reinsurance premium on the basis of which the pension supplement is calculated is 3.60% and is applied without a problem, i.e. pensioners with heavy IKA get a higher replacement rate and their pension is premiumized due to the “heavy marks”.
