Modifying the Penal Code, to increase the penalties for those who throw garbage in vacant places and public spaces, is the main objective of a bill that entered the Senate, in the second constitutional process, and that will be analyzed by the Constitution, Legislation Commission , Justice and Regulation.
The initiative increases the sanctioning ranges of the Penal Code for those who commit this type of behavior in vacant places and spaces such as squares, roads or streets, beaches or natural monuments.
For those who fail to comply with the rule, a minimum sentence of minor imprisonment (from 61 to 540 days) and a fine of 4 UTM (approximately $257,372) is proposed. In addition, the provision of services for the benefit of the community is established for those who litter, throw or abandon garbage, materials or waste in said spaces.
The penalty of provision of services will be applied and there must be prior consent of the convicted person; If there is no consent, the accessory penalty of a fine of 8 UTM (approximately $514,744) will be applied, without prejudice to the custodial sentence.
It is also proposed to sanction with the same prison sentence, a fine of 10 UTM and suspension from driving vehicles powered by mechanical or animal traction, whoever entrusts or transports, using motorized or non-motorized vehicles, the transport, transfer or deposit of garbage, waste or waste. to landfills or clandestine deposits.
