Pegi Setiawan’s attorney asked the panel of judges to present Rudiana in the pretrial hearing which will continue on Thursday (4/7) at the Bandung District Court (PN). Rudiana is the biological father of Rizky, one of the murder victims in Cirebon, West Java, in 2016.

“For the sake of justice and for the sake of upholding the law, we ask the panel of judges for the testimony of the applicant, Rudiana, to be presented at the trial,” requested Insank Nasrudin, one of Pegi’s legal representatives at the Bandung District Court on Tuesday.

Sole judge Eman Sulaeman then responded to the request from Pegi’s attorney. According to him, the pretrial judge is passive. “The pretrial judge cannot be like that, because the trial judge is not active, unlike the main case judge,” explained Eman.

According to Eman, the pretrial judge cannot force whether to present witnesses or not. The pretrial judge, unlike the main judge who can summon witnesses even those not in the examination report (BAP).

“If there is anything you want to submit, please go ahead, if there is nothing, please go ahead and the judge will not take sides. If you want to present Rudiana, it is up to you and if you are able, please go ahead, not up to us,” Eman explained once more.

Meanwhile, the West Java (Jabar) High Prosecutor’s Office (Kejati) returned the case files for the murder of Vina and Rizky in Cirebon in 2016 with suspect Pegi Setiawan to the West Java Regional Police investigators.

This was revealed by the Head of Legal Information for the West Java High Prosecutor’s Office, Nur Sricahyawija, that the files for suspect Pegi were given the code P19 or the case files were returned to investigators to be completed.

“The case file on behalf of suspect PS has been returned and received by fellow investigators. So, the case file of suspect PS still contains formal and material deficiencies,” said Nur Sricahyawija.

When asked regarding the deficiencies in the file, Nur Sricahyawija admitted that he might not convey them. “It cannot be conveyed because this is already included in our instructions to fellow investigators. According to the Criminal Procedure Code, when it is returned to the West Java High Prosecutor’s Office, we have a regulated time period of 14 days,” he said.

Nur Sricahyawijaya added that the case files received by the prosecutor from investigators had been examined or researched by six prosecutors including the prosecutor who served in 2016.

“Including the prosecutor who dealt with the matter in 2016, I made sure to also follow the progress of the investigation and join the investigating prosecutor,” he added. (Z-6)
