A man surnamed Cai was introduced to Vietnam to participate in a blind date through a dating agency. He saw Li Zhengmei at a glance, and paid an extra 43,000 yuan to marry the girl. “Hou Ji” was rejected, and Cai Nan determined that Li Nv had no intention of getting married, so he sued the marriage club for a full refund of more than 230,000 yuan. The first-instance judge believed that the fault was not entirely in the marriage friend club, so the marriage friend club should pay more than 80,000 yuan. Cai Nan refused to appeal, and the second-instance judge ruled that the marriage friend club should pay an additional more than 22,000 yuan.
The verdict pointed out that on February 23, 2019, Cai Nan flew to Ho Chi Minh City, Vietnam to participate in a blind date event through a marriage and friend agency. On the spot, he took a fancy to Li Nv, who was 10 days away from turning 18 years old. However, because Li Nv was relatively beautiful, he was married. The agency informed him that he had to pay an additional deposit of US$1,500 (regarding NT$43,000), and Cai agreed immediately and paid the full cost of the trip.
With the assistance of the staff of the marriage club, Cai Nan and Li Nv first held a wedding banquet in Vietnam two days later. On the night of the wedding banquet, Cai Nan wanted to kiss and ask for love, but Li Nv refused. Cai Nanqi was able to find that Li Nv had no intention of marrying him, and asked the marriage club for a replacement and a refund, but he was also rejected. He believed that the marriage club deliberately introduced girls under the age of 18 to him, preventing him from marrying in violation of local laws. The lawsuit demanded that the marriage and friend club refund a total of more than 230,000 yuan in fees.
During the brief court hearing in Kaohsiung, the Marriage Friends Association argued that Cai Nan knew that the other party was under the age of 18 when he wanted to marry Li Nv, but he was still in a hurry to hold the wedding banquet first. According to the contract signed by Cai Nan and the marriage club, the judge confirmed that Cai Nan did know that the other party was underage when he married Li Nv, and believed that Cai Nan and Li Nv only knew each other for a few days. Wanting to repent of the marriage, so the marriage club was sentenced to repay more than 80,000 yuan.
Cai Nan refused to accept the verdict and continued to appeal. During the trial, the Kaohsiung District Court believed that the “document authentication and translation fee” was underestimated by more than 22,000 yuan. Since the marriage club failed to provide evidence that the translation of these documents was completed, the marriage was convicted. The Friendship Society wants to repay the money, and the whole case is settled.
