Patty’s lawyer: Áñez cannot evade crimes because there are signed documents

Marcelo Valdez, attorney for former Congresswoman Lidia Patty, indicated this Tuesday that, despite the witnesses offered by the defense of the former temporary president, Jeanine AñezFor the oral trial for the case called Coup d’état II, it cannot evade the crimes because there are documents signed as proof of non-compliance with duties and resolutions contrary to the Constitution.

“What witnesses might they have before a signed document? A clearly signed document is contrary to the Constitution (State Policy); for example, that supreme decree (4078) that authorizes the Armed Forces to use force, that is a resolution contrary to the laws, to the control of conventionality to international treaties on human rights ”, he indicated.

He explained that, within the framework of these investigations, the former deputy and complainant in the coup d’état I case was not notified, because in this case the complainants are the Ministry of Government and the State Attorney General’s Office.

“The Coup d’Etat II case is once morest public officials, it is being handled by the Attorney General’s Office and the Ministry of Government, and the vast majority have already been apprehended (…) Only, there are military, police and civil servants, such as the case of Mrs. Áñez who they would have signed something that they did not have to sign because she has never been constitutional president, “he said.

For its part, Áñez’s defense offered 45 witnesses to face the trial. It is expected that tomorrow the Judicial Branch will issue the order to open the trial once morest the former de facto president and that the first sentence will be delivered within 45 days.

On November 30, within the framework of the investigations of the Coup d’Etat II case, the commission of prosecutors of the city of La Paz presented the formal accusation once morest the accidental ex-president, for the crimes of breach of duties and resolutions contrary to the constitution and the laws.

According to the Office of the Prosecutor, there are more than 70 pieces of evidence and almost twenty testimonial statements that indicate that Áñez had adapted his conduct to the criminal offense set forth in Article 153 of the Penal Code referring to resolutions contrary to the Constitution and the laws, in addition to have adapted their conduct to Article 154 of the same normative body for breach of duties.

The accusation includes the former commander of the Police, Yuri Calderón; the former commander of the Armed Forces, Williams Kalimán, and the Military High Command that helped Áñez to be installed in the Government in 2019. / Abi
