The lawyers of opponent Ousmane Sonko filed two requests to the Court of Justice of the Community of West African States (ECOWAS). According to information relayed by Libération, the lawyers are asking the Court to order the State of Senegal to suspend the dissolution of the Pastef party, as well as to temporarily restore the political rights of this party in view of the presidential election. scheduled for February 25, 2024.
In addition to this, Ousmane Sonko’s lawyers called on community judges to find that the State of Senegal violated their client’s rights of defense and the right to a fair trial. The complainants denounce the “sequestration” and “arbitrary detention” of their applicant, as well as the violation of his freedom of movement and association. They also denounce the violation of his right to participate in free, democratic and inclusive elections for the 2024 Presidential election, “due to legal maneuvers and stratagems which did not respect his rights to defense and to a fair trial” .

They believe that Ousmane Sonko was deprived of his civil and political rights without any final court decision having been rendered, among other grievances. Consequently, they ask the judges that the appeal filed by Sonko on April 28, 2023 in the case opposing him to Mame Mbaye Niang before the Court of Appeal be recorded, and that the procedure in the case opposing the applicant to Adji Sarr be taken back in accordance with article 307 paragraph 2 of the Code of Criminal Procedure, following his refusal to submit to the decision rendered in absentia and his arrest on July 28, 2023.
Sonko’s lawyers are also demanding the restitution of all property confiscated during his kidnapping, as well as the restitution of his party’s property, confiscated throughout the national territory upon the announcement of the dissolution.
