OStA chief Fuchs before the court in Innsbruck after an appeal

The head of the Vienna Public Prosecutor’s Office (OStA), Johann Fuchs, is again on trial in Tyrol on Thursday. After the acquittal of the allegations of breach of official secrecy and false testimony before the Ibiza U-Committee, which was issued in mid-March, the public prosecutor had filed a full appeal. Now the Innsbruck Higher Regional Court (OLG) will decide.

Fuchs was accused of having passed on parts of a complaint by the Economic and Corruption Prosecutor’s Office (WKStA) against a former “Presse” editor to the suspended section head Christian Pilnacek in December 2020. He is also said to have told Pilnacek that the WKStA did not pursue the complaint any further. On the other hand, according to the indictment, Fuchs is said to have lied to the Ibiza U Committee in March 2021 on precisely this matter. In the summer of 2022, the top lawyer was found guilty. However, the Higher Regional Court overturned the guilty verdict. The cause was therefore renegotiated in March at the Innsbruck Regional Court and ended with an acquittal.
