Orderer principle for apartment rentals in force since today

As of today, the orderer principle applies to apartment rentals. The agent’s commission now falls on the person who first commissioned an agent to broker the apartment – this is usually the owner of the apartment. So far, the tenants have had to pay most of the commission. At the same time, an increase in category rents of around 5.5 percent has come into effect. It is the fourth adjustment in almost 15 months.

The last rent increases of a similar magnitude were in November 2022, before that in June and April 2022. Category rents are automatically adjusted to inflation if inflation has reached the five percent hurdle since the last increase.

Justice Minister Alma Zadić (Greens) once once more promoted the reform of the brokerage law in a broadcast: This would relieve “hundreds of thousands of people looking for accommodation in Austria” and ensure “more justice on the housing market,” she emphasized. “Thanks to the reform, those looking for an apartment will in future save high broker commissions of up to two gross monthly rents. This is an important relief, especially in times of rising prices.”
