The Linz regional court announced this in response to an APA request. The man, who had previously evaded his trial, was caught by police during a traffic stop in July. He had the body of his wife and their three children in the car.
According to forensic medicine, the 38-year-old had died of natural causes a few hours earlier. The 39-year-old was arrested and taken into custody – not because of the incident with his wife’s body, but in connection with the charges of Holocaust denial and being a flight risk following he went into hiding before his trial. He is said to have compared the exit restrictions and compulsory vaccinations with the persecution of Jews on Telegram and in a YouTube video.
After his arrest, the court ordered a psychiatric report. The expert Adelheid Kastner comes to the conclusion that he is sane. There is no evidence of a psychiatric illness in the narrower sense, but there is a “querulatory-fanatical personality accentuation,” court spokesman Walter Eichinger quoted from the report. This component of his personality manifested itself during the pandemic. In the meantime, however, the defendant has distanced himself from Holocaust denial and, given the impression of his wife’s death and the question of how his children will be cared for, no further corresponding behavior is to be expected, according to Kastner’s prognosis.
The man will therefore have to answer before a jury as planned under the Prohibition Act. A trial date is expected at the end of October or beginning of November. The defendant was one of the key representatives of the anti-corona scene in Upper Austria, who had also registered a number of demos in this context and was very active on social media. The Upper Austrian was repeatedly involved in major conflicts with the police and authorities over a long period of time. In March 2022, he received a prison sentence of around one year, of which eight months were conditional, for defamation, false testimony, slander, insult and falsification of evidence. At the time, he was acquitted of the allegations of dangerous threats and the provision for abuse of office. Charges were then brought once morest him once more, this time under the Prohibition Act. He did not appear at the main hearing last August, and people have been looking for him ever since – until he was stopped by the police in July of this year.
