After a year-long litigation process, Finnish telecommunications equipment maker Nokia has recently won a second ruling from the District Court of Mannheim, Germany over its patents being infringed by Chinese mobile phone maker OPPO. Under the license, the essential patents of the other party’s 4G and 5G communication technology standards are used.
Declined to renew contract with Nokia
The lawsuit stems from the fact that Nokia and OPPO signed a cross-patent licensing agreement in November 2018 on 5G networking and related interfaces, security features and application technologies, which expired at the end of June 2021. After the agreement expired, OPPO rejected Nokia’s proposal to renew the license, but continued to use the other party’s patented technology. As a result, Nokia decided to take legal action in many countries such as Europe and Asia to sue OPPO for infringement.
OnePlus also needs to be banned
The German court ruled in Nokia’s favor this time, which means that both OPPO and its OnePlus mobile phone products are prohibited from being sold in Germany. OPPO responded that they have always been committed to good patent licensing cooperation in the industry, and opposed the use of litigation as a means to force the other party to accept patent licensing fees. OPPO also stated that it had appealed to Nokia in the courts in China, the Netherlands, and Germany last year over the infringement case.
