The Public Ministry requested a year of preventive detention, and detailed in the coercive measure request document that Cruz committed the act by denying a permit for the export of some 5,000 tons of used batteries.
According to the prosecutors in the instance of coercion measure, Cruz Mota went to the offices of the leader of the Modern Revolutionary Party (PRM) with the intention of killing him, because he had not obtained the approval of environmental permits for the export of used batteries. .

The defendant Miguel de Jesús Cruz de la Mota was transferred at 8:45 in the morning from the preventive prison of the Palace of Justice, located on the fourth floor, to the courtroom, located on the second floor. Once the measure was concluded, he was taken back to the preventive jail, where he will remain until he is transferred to jail.
Cruz de la Mota was arrested last Monday for the death of his childhood friend, which occurred on June 6 at the Environment offices.
Orlando Jorge Mera’s sister and son, Dilia Dilcia Jorge Mera and Orlando Jorge Villegas, who did not speak when they left the court, but showed sad faces, were present at the coercive measure hearing.
The defense attorney said that Jorge Mera’s family is the most interested in clarifying why Cruz de la Mota killed him; he also argued that the defense of the relatives is only seeing the reality, that it was a serious and horrendous event.
The defendant’s lawyer, Manuel Sierra, did not object to the one-year preventive detention requested by the Public Ministry.
Fausto Miguel Cruz’s lawyers affirmed last Thursday that they would not oppose the measure of coercion requested by the prosecutors, although they assured that their client “is not guilty.”
“The defense met and determined that, regardless of the budget that he (Fausto Miguel Cruz) has in order not to impose preventive detention on him, the best thing is, out of prudence, we are not going to oppose the coercive measure initiated by the Public Ministry,” said Ivo René Sánchez, member of the defendant’s defense.
The hearing was scheduled to be held last Thursday but the magistrate decided to set a new date for hearing the request for a coercive measure, as a result of the victimizer’s defense stating that they needed more time to review the file.
