One and a half years partly conditioned for stalking the ex-girlfriend

A 40-year-old was sentenced to 18 months in prison, three months of which were unconditional, at the Vienna Regional Court on Tuesday for persistent persecution and attempted coercion of his ex-girlfriend. The man had been in custody since September. Since this time will be counted towards the unconditional part of his sentence, he can leave prison next Friday. The 40-year-old also accepted all the instructions given to him by the court and the verdict is final.

The man was in a relationship with the woman, who was three years his junior, until the end of June 2023. “It was an emotional relationship with ups and downs. There were very strong feelings on my part,” said the defendant. When the 37-year-old told him that she no longer wanted to be with him, he suffered “a nervous breakdown.” And from that point on, he gave the woman no peace, as the 37-year-old described following the defendant had been taken out of the courtroom – in accordance with her wishes.

“He didn’t let me sleep anymore,” the witness reported. Even though she had taken out restraining orders once morest him and contact and approach bans were in effect, he was always visible outside the window whenever she looked out: “He was marching up and down the street. Even at midnight, even at 2 a.m the morning.” In the evening or at night she caught him several times listening at her door outside her apartment, often following midnight: “He was always standing in front of my door. He also threatened her with voice messages in which he told the woman, for example, that he would take her to a psychiatric hospital if she did not meet with him for a “final discussion”. He also stopped her in front of her workplace or in her gym, so that in the end the 37-year-old no longer dared to leave her apartment alone. She even distributed leaflets with the 40-year-old’s photo in her home and asked the neighbors for help if he was found in the stairwell. “I didn’t dare go anywhere for two months,” she said.

The defendant confessed in court and admitted guilt. The latter was probably mainly due to his imprisonment, as his defense lawyer made clear. “This was his first time in prison. Prison fever has pulled the rug out from under him. He has deteriorated in the last few months, he is a broken man.”

Judge Alfred Hebenstreit-Weininger ordered the 40-year-old to refrain from any future contact with his ex-girlfriend. Otherwise, Hebenstreit-Weinauer emphasized that he must expect that the suspended sentence of 15 months will be revoked and will have to be served. The man was also ordered to undergo psychotherapeutic treatment.
