(PLO)- Officials who issue land use right certificates and many other positions in the natural resources and environment sector must periodically change their working positions if they have enough working years as prescribed.
Circular 21/2022 of the Ministry of Natural Resources and Environment stipulating the list and period of periodical change of working positions in agencies, organizations and units in the field of natural resources and environment at local authorities. from today (February 6).
This Circular stipulates that cadres and civil servants who do not hold leadership or managerial positions and employees who directly contact and handle work from full two to five years must periodically change their working positions.
Positions subject to periodic conversion include issuance of certificates of land use rights, ownership of houses and other land-attached assets; granting licenses to survey, explore and exploit minerals.
Issuance, renewal, adjustment and re-issuance of environmental permits with contents on discharge of wastewater, exhaust gases, generation of noise and vibration, must be treated to meet technical regulations and solid waste management as prescribed. ; performing hazardous waste treatment services; granting permits for exploration, exploitation and use of water resources.
Locations for handling records of land allocation, land lease, land recovery, change of land use purpose, registration of land use rights, ownership of houses and other land-attached assets.
Assign land quotas; managing the application of compensation, identifying land users subject to compensation and support; compensation level, support in site clearance; handle environmental violations.
This Circular also specifies cases in which the change of working position has not been carried out (defined in Decree 59/2019). Including people who are being examined and disciplined; persons being examined, verified, inspected, investigated, prosecuted or tried.
In addition, the person being treated for a serious illness is certified by a competent health authority; people who are going to concentrated school for 12 months or more, people who are being seconded; women who are pregnant or nursing a baby under 36 months old; Men who are raising children under 36 months old due to the death of their wives… are also in the case of not changing their working positions.
Cases subject to periodic change of working position as prescribed in Circular 59/2014 of the Ministry of Natural Resources and Environment stipulating the list of working positions and time limit for periodically changing working positions for civil servants, officials in the natural resources and environment sector who have been approved by competent authorities to change their working positions before the effective date of this Circular shall continue to comply with the provisions of Circular 59.
Cases subject to periodic change of working position as prescribed in Circular 59 which have not been approved by competent authorities to change working position from the effective date of this Circular, shall comply with the provisions of Circular 59. specified in this Circular.
