North Dakota Abortion Legislation: Investigation Findings and Legal Ramifications

STANLEY, N.D. (KFGO) – The state’s attorney tasked with reviewing an outside investigation into the deletion of former North Dakota Attorney General Wayne Stenehjem’s emails says he will not file charges.

Mountrail County State’s Attorney Wade Enget says he did not find sufficient evidence in the report by the Montana Division of Criminal Investigation to warrant the prosecution of anyone for tampering with public records.

According to the report from the Montana DCI, after Stenehjem’s death in January 2022, his executive assistant Liz Brocker ordered the state’s IT department to wipe Stenehjem’s email account. Brocker said she was following orders from then-deputy attorney general Troy Seibel.

Enget says that at the time the emails were deleted, there was no clear definition of whether electronic mail or communication was considered a “government record” under North Dakota’s Century Code.

During the last legislative session, lawmakers changed the language in the code to include “electronic mail or communication” to remove any ambiguity from the law.
