Code Overview

On October 17, 2023, the Council of Ministers of OHADA adopted in Kinshasa (DRC) a new Uniform Act organizing simplified recovery procedures and enforcement routes, thereby repealing that of April 10, 1998, following 25 years of applications. This Uniform Act, which is the most widely used of all OHADA’s normative production, is a true code which, outlining the guidelines for debt recovery and enforcement methods, has generated abundant case law which continues to fuel professional practice and other academic work. Hence the interest of the authors in devoting annotations and comments to it to help enrich it. Indeed, the Recovery and Enforcement Code has the particularity, through the annotations it contains, of largely reporting, article by article, the case law, as well as the CCJA up to date as of December 31, 2023. than those of the most recent national jurisdictions.

In addition, the authors of the Code, proven specialists in OHADA recovery law, set out to scrutinize and comment on the provisions of the Uniform Act, highlighting the strengths and weaknesses of the innovations that have occurred, as well as its probable difficulties of implementation. application.
