New program makes it easier for undocumented immigrants to obtain a green card for permanent residence in the United States

Starting this Monday, August 19, approximately 500,000 undocumented immigrants in the United States will be able to access permanent residency thanks to a new program called “Parole in Place,” implemented by the government of President Joe Biden.

This program is aimed at immigrants who have resided in the country continuously for more than a decade and are married to U.S. citizens. In addition, it is estimated that around 50,000 children of these spouses could also benefit from this initiative.

The U.S. Department of Homeland Security will be responsible for evaluating each application on an individual basis.

Requirements

To be eligible, applicants must have resided in the country for at least 10 years, be legally married to a U.S. citizen before June 17, 2024, and not pose a threat to public safety or national security.

Immigrants who meet these criteria will be able to apply for permanent residency without having to leave the United States, thereby avoiding the lengthy family separations that have been common under current immigration laws.

The application process will officially begin on August 19, and interested parties must submit their applications electronically through Form I-131F, which costs $580.

Online processing

Please note that this form can only be completed online, and mail submissions will not be accepted or fee waivers offered.

To facilitate the process, the United States Citizenship and Immigration Services (USCIS) will hold a webinar in Spanish on the same day the program opens, explaining the steps and details required to complete the application.

Applicants must submit documentation including proof of identity, evidence of marriage to a U.S. citizen, and proof of continuous residence in the United States for at least 10 years, such as rent receipts, school records, or tax returns.

Applicants’ children may also benefit, provided they meet the established requirements, and must provide documentation supporting their family relationship and their presence in the U.S. before the deadline.

Recommendations

Applicants are encouraged to create or update their myUSCIS account to facilitate the application process and consider consulting with an immigration attorney, especially if they have had previous problems at the border.

This program represents a significant step for thousands of undocumented immigrants who have made the United States their home, giving them a unique opportunity to regularize their immigration status without having to leave the country.
