New Draft Law for Penalties on Witchcraft, Sorcery, and Fraud in Egypt

A number of citizens questioned the penalties for crimes of sorcery, witchcraft, fraud, and fraud, following the artist Fifi Abdo recently appeared in statements during the ET Arabic program, crying out for many health problems due to “magic and business.”

New draft law for the crimes of witchcraft and sorcery

Representative Doaa Oreibi, presenter of the draft law, said in the explanatory memorandum to the draft law that due to the large number of witchcraft and sorcery crimes and that the Egyptian law did not provide for witchcraft and sorcery crimes directly and did not address them from near or far, but it is punishable as a crime of fraud according to the text of Article 336 of the Egyptian Penal Code.

She pointed out that a distinction must be made between two things, namely those who perform legal ruqyah without obtaining a financial reward, provided that their actions do not exceed the legal ruqyah, and between witches, charlatans and sorcerers who harm people and compromise their safety and the safety of their lives and families, because religious scholars agreed that learning and teaching magic and its practice is forbidden by Sharia, which required preparing the presented project and harshening the penalties if those crimes were committed to deter and limit those who committed them.

Articles of the bill

The draft law stipulated the addition of a new Article 336 bis / 1 to Law No. 58 of 1937, which reads as follows:

Imprisonment and a fine

Imprisonment and a fine of not less than twenty thousand Egyptian pounds shall be imposed on anyone who commits acts of magic and sorcery, whether in reality or through deception with or without material consideration. Saying or deed is considered witchcraft if it is intended to affect the body, heart, mind, or will of others, directly or indirectly, whether real or imagined. It is considered an act of sorcery to control people or benefit them by any means to make them see something contrary to reality with the intention of exploiting them or influencing their minds. It is also considered an act of sorcery to claim knowledge of the unseen, to know secrets, or to tell what is in the conscience, by any means whatsoever, with the aim of exploiting people. In all cases, the ruling includes the confiscation of the seized items.

The draft law stipulates that a new Article 336bis/2 shall be added to Law No. 58 of 1937, which reads as follows:

The following shall be punished with imprisonment and a fine of not less than twenty thousand pounds:

Anyone who seeks the assistance of a magician with the intention of influencing the body, heart or will of others. Anyone who brings or enters the country or possesses, obtains or disposes of any kind of disposal in books, talismans, materials or tools dedicated to magic or sorcery. Anyone who promotes by any means, including social media, any act of magic or sorcery.

Punishment of quackery and sorcery in the law

Through this report, we monitor the punishment for anyone who performs deception and sorcery in accordance with the articles of the law as follows:

The penalty for acts of deceit and sorcery falls under the text of Article 336 of the Penal Code, which is related to acts of fraud, which may be punishable by up to three years in prison.

Imprisonment and a fine of not less than twenty thousand Egyptian pounds shall be imposed on anyone who commits acts of witchcraft and sorcery, whether in reality or through deception, with or without material consideration.

Saying or deed is considered an act of magic if it is intended to influence the body, heart, mind or will of others, directly or indirectly, whether real or imagined.

It is considered an act of sorcery to control people or benefit them by any means to make them see something other than the truth with the intention of exploiting them or influencing their minds.

It is also considered an act of sorcery to claim knowledge of the unseen, to know secrets, or to tell what is in the conscience, by any means, with the aim of exploiting people.

– In all cases, the judgment includes the confiscation of the seized items.
