Dubai: New court to hear cases of inheritance disputes starts functioning in Dubai. Muslims and non-Muslims of all nationalities can submit complaints to the court starting in September. Officials announced this in a press conference held at the Dubai Personal Status Court. A system has been prepared to register cases online.

They will first be examined by a preparatory judge and try to reach an amicable settlement. If this fails, the court will take the case into consideration. The new court will help speed up judgment in inheritance dispute cases. Here there is a requirement that cases should be tried within one month and the verdict delivered within one year. The judgments of the court are final and cannot be appealed. Meanwhile, a review petition can be filed.

All new inheritance cases pending in other courts in Dubai will now be heard by this court. With this, it will be the only judicial body in the emirate to hear such cases. In 2021 alone, 1,800 cases related to inheritance were heard in various courts in Dubai. It was decided by Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, UAE Deputy Prime Minister, Minister of Finance and Chairman of the Judicial Council, on the recommendation of Sheikh Mohammed bin Rashid Al Maktoum, UAE Vice President, Prime Minister and Ruler of Dubai. Director General of Dubai Courts Tarish Eid Al Mansoori said that the new court was formed. He added that the construction of the court building has been completed and the court rooms and IT system will be operational in September.

This is how the new court works

  • The case is registered in the Dubai Court of Personal Status
  • Court recommends settlement
  • If no settlement is reached, the case is referred to the Inheritance Court
  • The Preparatory Judge examines the details of the case and ascertains the properties etc
  • Cases are referred to a panel of judges in the Inheritance Court
  • Reconciliation is suggested
  • If no settlement is reached, the probate court judges will proceed with a hearing
  • The court will issue a final verdict after hearing the arguments
