Negotiation against Salzburg Festival postponed to April 8th

Today’s hearing of a lawsuit once morest the Salzburg Festival before the Labor and Social Court (ASG) in Vienna has been postponed to April 8th to hear further witnesses and the plaintiff, the singer Martin Thoma. The case concerns an alleged violation of payment obligations in connection with corona-related postponements and cancellations in 2020.

At the hearing, led by Patricia Wolf, Vice President of the ASG Vienna, Ernst Raffelsberger, former choir director of the Vienna State Opera Choir Concert Association, and Petra Gaich, artistic operations director of the Salzburg Festival, were interviewed. The commercial director of the Salzburg Festival, Lukas Crepaz, spoke on behalf of the defendant. After the negotiation, the latter saw the legal position of the Salzburg Festival, according to which there was no contractual relationship with the plaintiff, confirmed in a telephone conversation with the APA. The Vienna State Opera Choir Concert Association undertakes to provide a trained choir at the start of rehearsals, although its composition is up to it.

For the plaintiff’s lawyer, essential statements and Thomas’ statement are still missing in order to provide the court with a clear picture. The contractual situation is currently very complicated, lawyer Georg Streit told the APA. The professional association for freelancers in the performing arts and music “art but fair UNITED”, whose spokesman is the chamber singer Wolfgang Ablinger-Sperrhacke, sees the case as a model lawsuit, which also includes allegedly inadmissible employment relationships in the choir sector and decades of non-payment and insurance during the pre-rehearsal period the additional members of the Vienna State Opera Choir Concert Association should be clarified in court.

According to the dispute, at the April date, in addition to the plaintiff, Anna-Maria Birnbauer and Karin Wieser from the Concert Association of the Vienna State Opera Choir as well as Walter Zeh, artistic director of the “Philharmonia Chor Vienna”, will be available to answer questions to the court.
